California law places great significance on insuring that the intentions of a decedent with respect to
his or her property are met after death. In a probate procedure, the court is directly involved from
the start. By contrast, the assumption with a trust is that the court will not be involved.
Nonetheless, by law the court has automatic jurisdiction over all trusts and all acting trustees.
Whether it is a will or a trust that is involved, a petition brought before the Probate Court is all that
is needed to ask for the courts involvement in seeking a just administration.
