Does a Trustee Have to be Paid?
No.
The person who sets up a trust has the ability to set the compensation of his trustee in any way he sees fit.
However, if the trust document makes no provision for compensation, then the courts will allow a "reasonable"
compensation. In addition, it is possible for a trustee to ask the court to approve a compensation different than
what is provided in the trust if the circumstances of administration are significantly different than what was
contemplated by the person who set up the trust, or if the compensation set in the trust document would be
inequitable.
